TERMS AND CONDITIONS OF USE OF THE APPLICATION

These Terms and Conditions govern access to and use of the SOWL application (hereinafter, the “APPLICATION”), which SOWL Technologies SL makes available to users as a SaaS platform.

Access to the APPLICATION implies that the user acknowledges having read, understood, and accepted these terms and conditions without reservation. If the user does not agree with them, they must refrain from using the APPLICATION.

1. PURPOSE

The APPLICATION is a technological platform designed for the search, analysis, correlation, and visualization of information leaks, data breaches, and digital evidence related to a specific search term, such as domains, brands, email addresses, usernames, identifiers, or any other digital asset defined by the user.

SOWL enables the identification, organization, and analysis of information potentially exposed in open sources, public repositories, known data breaches, and other legitimately accessible sources, with the aim of supporting cybersecurity, compliance, digital forensics, risk prevention, and digital asset protection activities.

In this context, SOWL Technologies SL provides the following services to the client:

  • Access to the APPLICATION, allowing searches, visualization of results, evidence, and associated risk metrics.
  • Technical support, maintenance, updates, and continuous improvement of the software.
  • Visualization, classification, and risk prioritization tools derived from the obtained results.

The APPLICATION is accessible via web browser and compatible devices, with no local installation required.

2. FEATURES

The APPLICATION offers, among others, the following features:

  • Search for information related to data leaks and breaches associated with a defined term.
  • Visualization of structured evidence (timelines, risk rankings, exposure matrices, charts, and statistics).
  • Classification and tagging of potentially sensitive information.
  • Historical analysis and exposure trend monitoring.
  • Role-based and user-controlled access.
  • Export of results and evidence for internal client use.

SOWL does not guarantee the absence of false positives nor the absolute completeness of results, as information depends on external and third-party sources.

3. USER OBLIGATIONS

The user undertakes to:

  • Use the APPLICATION exclusively for legal, legitimate, and authorized purposes.
  • Not use the platform for unlawful activities or activities that infringe third-party rights or applicable regulations on data protection, communications secrecy, or intellectual property.
  • Not attempt to access information, accounts, or systems without proper authorization.
  • Not perform intrusion testing, vulnerability exploitation, or reverse engineering of the APPLICATION.
  • Not submit workloads intended to destabilize the service (DDoS attacks or similar).
  • Not reproduce, resell, sublicense, or make the APPLICATION available to third parties without express authorization.
  • Notify any security incident detected in their account or unauthorized access.

The use of SOWL as a hacking, espionage, or illegal surveillance tool is expressly prohibited.

3.1. WARRANTIES AND LIABILITY

SOWL Technologies SL shall not be liable for:

  • Improper use of information obtained through the APPLICATION by the user.
  • The accuracy, truthfulness, or timeliness of data obtained from external or third-party sources.
  • Damages arising from decisions made by the user based on the displayed results.
  • Service unavailability due to external causes, force majeure, or third-party provider failures.

The user is solely responsible for the subsequent processing of obtained information and for ensuring compliance with applicable regulations.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All intellectual and industrial property rights over the APPLICATION, including its code, design, structure, algorithms, trademarks, and contents, are the exclusive property of SOWL Technologies SL.

Any unauthorized reproduction, distribution, transformation, or exploitation is strictly prohibited.

5. PRIVACY POLICY

Who is the data controller?

SOWL Technologies SL, as data controller, processes personal data in accordance with the GDPR and applicable data protection regulations.

What purposes do we process personal data for?

Personal data are processed for the following purposes:

  • Managing access to and use of the APPLICATION.
  • Providing technical support and maintenance.
  • Managing contractual and billing relationships.
  • Sending service-related communications.

What personal data are processed?

  • Identification data: name, surname, email address, username.
  • Professional and company-related data.
  • Billing data.
  • Technical access and usage logs.

SOWL does not analyze or exploit third-party personal data unless such data have been voluntarily entered by the user under their sole responsibility.

  • Performance of a contract (Art. 6.1.b GDPR).
  • Compliance with legal obligations (Art. 6.1.c GDPR).
  • Legitimate interest (Art. 6.1.f GDPR).

Data retention

Personal data will be retained for the duration of the contractual relationship and for legally required retention periods.

Data disclosures and international transfers

Data may be processed by technology service providers (cloud, CRM, accounting) with appropriate safeguards in accordance with the GDPR and the EU-US Data Privacy Framework.

6. USER RIGHTS

Users may exercise their rights of access, rectification, erasure, objection, restriction, and data portability, as well as lodge a complaint with the competent supervisory authority.

8. DISCLAIMER OF LIABILITY

SOWL does not guarantee specific outcomes or the detection of all existing leaks. The APPLICATION is provided “as is”, without additional implied warranties.

9. GOVERNING LAW AND JURISDICTION

These terms are governed by Spanish law. Any dispute arising from their interpretation or application shall be submitted to the courts of Madrid.

We need your name or company name and an email, these are the only data we will ask you for and we guarantee total confidentiality in their treatment.
